An affidavit of truth is a statement made by a “sovereign citizen” disavowing the legal authority of federal, state, and municipal governments. It is based on the US Constitution and rejects the powers of state and municipal authorities. The document revokes any power of attorney asserted by the federal government and disavows actions such as acquiring driving licenses, voting, and enrolling children in public school. The affiant does not acknowledge the legitimacy of any form of government benefit and voting is not a requirement.

The affidavit does not fit the traditional definition of an affidavit as “an affidavit of fact used for legal purposes”. Rather, it represents a statement of the individual’s legal and political beliefs. It is most often associated with the Sovereign Citizen Movement, and some of the movement’s beliefs are expressed in the affidavit.

The legal theory behind this document is based on sections of the United States Constitution, which it interprets as limiting the powers of the federal government to United States territories, military bases, and federal offices. The affidavit states that the signer of the affidavit, the “affiant,” is a “sovereign citizen” and not a citizen of the United States or subject to any of its laws except the Constitution which applies to individuals.

The document further states that the affiant is not a resident of the United States or its “ward” or “chavable.” The registrant also does not recognize any statutory law created by any legislator, only the constitutional law. This statement stems from the belief that all acts of Congress and US states applied to sovereign citizens are unconstitutional and therefore illegal. The affidavit revokes any “power of attorney” the affiant asserted by the federal government regarding any Social Security number assigned to him.

There is also language in the affidavit of truth that the affiant does not acknowledge the legitimacy of any form of government benefit. Voting is not a government-granted privilege, but an inherent right of a sovereign individual. Voting is not a requirement, except when protesting the illegal basis of government in the United States.

Concerning the jurisdiction of state and federal governments, an affidavit of truth lists certain actions of the registrant that are reversed or disavowed. Acquiring driving licenses, voting, and enrolling children in public school are said to have been done under duress and to prevent government harassment. The document declares that any use of a bank account was out of necessity, because all banks are illegally regulated by the federal government, leaving no other alternatives. The affidavit disavows all of these actions and states that they do not reflect the registrant’s intention to submit to any form of governmental authority.
