Non-appearance warrant: what is it?

Print anything with Printful

A non-appearance warrant is issued when someone fails to appear in court or violates probation. It has no statute of limitations and can be issued outside the area. Failure to respond to a traffic-related matter or a jury duty subpoena can also result in a warrant. It is important to respond and attend court or seek legal help. Sometimes, people may not receive a subpoena and be unaware of the warrant. It can usually be resolved easily.

A non-appearance warrant is a warrant for an arrest issued when someone fails to appear in court and for certain types of probation violations. Also known as an FTA warrant, it is issued at the discretion of a judge. Until the person appears in court, the warrant will not be terminated.
These warrants do not have a statute of limitations. They can also be notified outside the area where the warrant was issued. Thanks to law enforcement’s increasing use of electronic data-sharing systems, many people with old outstanding warrants find themselves in situations where they are arrested with warrants they may have completely forgotten about.

One of the most common reasons a judge issues a no-show warrant is when someone fails to appear in court on a traffic-related matter. Many courts allow people to file applications by mail, including guilty pleas, but people who fail to take any sort of action by mail on a fine will be expected in court. If they don’t show up, an arrest warrant can be issued. Any other situation where individuals have been subpoenaed and fail to comply with the subpoena may result in a non-appearance.

Even if people believe a subpoena was issued in error or that the allegations in a court case are false, they must respond. Individuals who cannot attend court may write to the court to explain the situation and explore the possibility of termination by mail or a change of court date; an attorney can help with this. All others should attend court.

Judges can also issue free trade warrants for people who fail to comply with a jury duty subpoena. This practice is more common in areas where there are low compliance rates combined with a shortage of jurors. Individuals who receive a jury summons and cannot comply must return documentation to indicate so. Many summonses come with a form on the back that people can fill out to explain why they cannot participate in jury service as required.

There are cases where legal subpoenas are issued and people never receive them. For example, a jury subpoena might be sent to an old address after the forward order expired, and the new person at that address might not return the subpoena to the post office. Therefore, it is sometimes possible to have a no-show warrant without being aware that you have missed a court appearance. People who are arrested on such warrants shouldn’t panic, as the matter can usually be resolved easily.
