A deed of gift is a legal agreement that transfers ownership and legal rights to specified property, often used when donating historical documents or materials to a museum. It sets conditions, restrictions, and dispositions, and may require signatures and witnesses. Legal transfer of title may have additional requirements, and a lawyer’s assistance can be valuable. The America’s Cup Deed of Gift is a famous example.

A deed of gift is a formal legal agreement by which one party transfers ownership and legal rights to specified property, both personal and real, to someone else. A common use for this occurs when a person decides to donate historical documents or materials to a historical foundation or museum. In this case, an act regulates the legal relationship between the donor and the organization and the conditions under which the donor gives ownership of the materials to the organization. In this sense, the deed protects the interests of both parties and enshrines the legal rights of each party with respect to the property specified in the deed.

More specifically, a deed of gift sets forth the conditions of the gift, any restrictions on the use of the gift, the disposition of unwanted property, the further transfer of the gift to unrelated persons, and any other dispositions the parties wish to include therein. Legal requirements for what items or information to include may vary from one jurisdiction to another. Some places require that the deed contain the signatures of not only the parties to the agreement, but also a certain number of witnesses. Other jurisdictions may require that a notary public witness and certify all deed signatures.

In some jurisdictions, there are additional requirements for making the legal transfer of title to the property that is the subject of the deed, particularly when it comes to real estate or land. For example, some venues require the parties to formally register the deed as registered. In the case of written material, there may be copyright issues to address. Engaging the assistance of a lawyer can be invaluable in carrying out any act to ensure that the person giving the gift has complied with all applicable laws and requirements.

Probably the most famous agreement of this kind concerns the America’s Cup, a famous sailing regatta. The Deed of Gift is the instrument that establishes the official sailing rules for the America’s Cup. Originally written in 1852, the owners of the yacht America, winner of the first America’s Cup, transferred ownership of the trophy to the New York Yacht Club in 1857. Legally it is a fiduciary document registered in the New York State Supreme Court.
