This term describes the state of mind of the murderer, or what common law calls mens rea, which is Latin for “guilty mind.” The state of mind required to call murder a homicide, and the state of mind to which the term “premeditated malice” refers, is to kill intentionally or to kill recklessly with extreme contempt for human life.

Murder is often classified into various degrees, depending primarily on the particular state of mind the killer was in. A homicide is usually classified as first-degree homicide, the most serious type of homicide, when the killer is determined to have acted deliberately with a premeditated intent to kill another. This means that he or she planned or thought about the murder before doing it.

Some jurisdictions do not impose capital punishment for any crime and there is no capital murder in those places. In places that use the death penalty for some types of murder, it is typically only used for the most serious forms of murder. These forms of homicide include first degree murder; homicides with specific aggravating circumstances, such as the murder of a police officer; or capital murder, when the murder is committed as part of another serious crime, such as burglary or bank robbery. These will be considered capital crimes because those who commit them could face capital punishment.
