Transactions to all affiliated banks cannot add up to more than 20% of the capital. In addition, any credit provided to an affiliated bank must be secured credit only.

Transactions must be planned and reviewed in advance to ensure they comply with regulations. Those that do not meet the requirements initially must be restructured until they meet regulatory compliance.
Violations of regulation W by financial institutions can be substantial. Civil penalties may apply if the institution is found guilty of violations. An investigation will determine whether the violation was intentional or negligence, and the penalties imposed will depend on the outcome of the investigation. If it is determined that the violation has some individual benefit or has affected the financial health of the institution, there may be more serious consequences.
